General Conditions of Sale - Caveau De Bacchus Online Store

  1. Application domain

The products or services that we offer in our online store are aimed exclusively at consumers with an address in Switzerland (hereinafter the “Customer(s)”).

1.2. The Caveau de Bacchus online store accessible on the site www.caveaudebacchus.ch (hereinafter the “Online Store”) is operated by the company K&K Promotions SA, a company incorporated under Swiss law under the commercial name “ Le Caveau de Bacchus » (hereinafter “Caveau de Bacchus”, “we”, “our”).

1.3. These general conditions of sale (hereinafter the “CGV”) apply to all contracts concluded between Customers and Caveau de Bacchus concerning products or services offered in the Online Store.

  1. Orders

2.1. Any order placed by a Customer with our Online Store is subject to acceptance by us depending on available stock. We will send the Customer a confirmation of the order, by email, depending on available stock. The Customer must immediately notify us, by email, of any error in the order confirmation. If no notification is made by the Customer, the confirmation of the order is considered correct and accepted.

2.2. The Customer undertakes to accept any delivery made in accordance with the order confirmation sent by the Caveau de Bacchus.

  1. Selling price

3.1. The prices indicated on product lists, catalogs, offers, newsletters and on our Online Store are expressed in Swiss francs (CHF) including tax (8.1% VAT) per unit.

3.2. The prices mentioned in our Online Shop are in principle valid, subject to obvious errors. Claims for damages in the event of obvious errors are excluded. We reserve the right to modify the prices, conditions and vintages indicated in our Online Store.

  1. Payment Terms

Payment of the sale price is made either by card or bank transfer, immediately at the time of ordering, to the extent provided and available on our Online Store.

  1. Delivery

5.1. Deliveries are made by carriers to the address and contact person indicated by the Customer. The Customer can also arrange with the Caveau de Bacchus to collect the products directly from the store or depot without delivery costs.

5.2. Our stores have a free “Click & Collect” service, with the possibility of collection within two working days of receipt of the online order.

5.3. Delivery costs in Switzerland for any online order from CHF 400.- including tax are free to the Customer.

5.4. Delivery takes place provided that we have been supplied in a timely and proper manner by our suppliers and that there is no case of force majeure. Force majeure includes civil conflicts, wars, strikes and other social movements, government decisions, natural disasters, as well as the cessation of deliveries from an upstream supplier. We assume no liability for delivery delays attributable to our suppliers or third parties or if the delay is due to force majeure.

  1. Reservation of title

The products delivered to the Customer remain our property until full payment of all invoices established on the basis of the order confirmation, including all incidental costs. The Client expressly authorizes the Caveau de Bacchus, if the law of the country concerned requires it, to register a reservation of ownership.

  1. Notice of defects and complaints

7.1. The Customer is required to check the condition of the products upon receipt, in accordance with usual commercial practices. Any defect noted by the Customer at the time of delivery (damaged bottles, missing bottles, etc.) must be immediately reported by email to our customer service at ( admin@bacchus.ch ). In any case, acceptance of the products is deemed to have occurred to the extent that the Customer has not communicated a complaint by email to the address indicated above within five (5) working days from the date delivery of products.

7.2. If the product is deemed defective, the Customer must return it accompanied by a copy of the invoice and a detailed description of the defect. Any transport costs will be the responsibility of the Customer. We will then, at our choice, replace the product or perform a secondary service.

7.3. No guarantee is offered in the event of a complaint regarding possible corked wines or those presenting deviated aromas.

  1. Responsibility

All cases of contractual violations and their legal consequences, as well as all of the Customer's rights, regardless of the title on which they are asserted, are definitively regulated in these General Terms and Conditions. All other rights of the Customer – regardless of their legal nature – are, to the extent permitted by law, excluded. Neither the Caveau de Bacchus, nor its employees and possible vicarious agents can be held responsible for damage which did not occur to the goods themselves, in particular for consequential damage, loss of profit or any other material damage. suffered by the Customer.

  1. Data protection

9.1. We may need to collect (and process) the Customer's personal data, including name, first name and address (the "Personal Data"), in the context of order execution or invoicing, in order to comply with contractual or legal requirements, in particular accounting requirements.

9.2. Personal Data is saved within the limits of the legal deadlines applicable to data retention. We may disclose Customer Personal Data to service providers for sales or accounting support purposes, or to other third parties where required by law.

In order to comply with legal requirements, Customers undertake to be 16 years old on the date of any wine order and 18 years old on the date of any spirits order. We remind Customers that alcohol abuse is dangerous for their health and invite them to consume our products in moderation.

  1. Changes

We reserve the right to modify the General Terms and Conditions at any time. The General Terms and Conditions apply immediately to any order placed after the date they are posted online on our website.

  1. Applicable law and forum

12.1. Swiss law is applicable to these General Terms and Conditions. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.

12.2. The parties accept that all disputes resulting from the application, non-application or interpretation of these General Terms and Conditions will be brought before the Courts of Geneva, Switzerland, with the exception of appeals to the Federal Court of Lausanne, Switzerland.
